WINDS OF CHANGE IN ARGENTINA: Substantial amendments in the prosecution of trademarks and patents.
The Decree 27/2018 of January 10, 2018, (here in after the “Decree”) amends certain articles of the current Law of Trademarks and Designations (Law No. 22,362), the Law of Patents and Utility Models (Law No. 24,481), and Decree-Law No. 6673/1963. The recitals of the “Decree”, indicate the need to implement an administrative procedure for the parties, prior to the judicial instance, for the administrative procedure and resolution of the oppositions in trademarks, in order to reduce deadlines in obtaining resolutions. In connection with Utility Models and Designs, with the proposed amendments, users may make multiple applications for registration per file, adopt new technologies in the manner of submitting drawings, and request the postponement of publications. We have prepared a comparison of the present procedures and the changes that are introduced by the Decree, which are not yet in force upon receiving this Newsletter.

DE CAMBIO EN ARGENTINA: Modificaciones de importancia en procedimientos en marcas y patentes. El presente artículo trata acerca de los puntos más importantes respecto del D.N.U. Nº 27/2018 del 10 de enero de 2018, de aquí en adelante el “Decreto”,el cual modifica determinados artículos de la actual Ley De Marcas y Designaciones (Ley Nº 22.362), la Ley De Patentes De Invención Y Modelos De Utilidad (Ley Nº 24.481), y del Decreto-Ley N° 6673/1963. En los considerandos del “Decreto”, podemos apreciar que en el ámbito marcario, se manifiesta la necesidad de implementar un procedimiento administrativo para las partes, previo a la instancia judicial, para el tratamiento y resolución de las oposiciones a las solicitudes de registro de marcas, con el fin de reducir plazos en la obtención de las resoluciones, así como en los Modelos y Diseños que, con las modificaciones que se proponen, los usuarios podrán efectuar solicitudes múltiples de registro por expediente, adoptar nuevas tecnológicas en el modo de presentar dibujos, y solicitar el aplazamiento de la publicación. He aquí una reseña de lo que establece la actual normativa y los cambios que introduce el “Decreto”, los cuales a la fecha del envío de este Newsletter aún no han sido implementados.
